Contractor Disclaimer

This disclaimer clarifies the relationship between contractors, companies, and OwnWorks. By using the Platform, all parties agree to the following.
1. Independent Status
Every contractor on OwnWorks is an independent business or independent operator. Contractors are not employees, agents, partners, or franchisees of OwnWorks or PFX Logistics.
2. OwnWorks Does Not Supervise Operations
- OwnWorks does not supervise, schedule, dispatch, or manage routes, deliveries, loads, or any contractor operations.
- OwnWorks does not set rates, hours, equipment standards, or service requirements between contractors and companies.
- OwnWorks does not participate in pickups, deliveries, or last-mile execution.
3. Company Responsibilities
Companies posting opportunities are responsible for:
- Defining onboarding requirements, background checks, drug testing, and equipment standards as applicable.
- Verifying contractor qualifications, licensing, insurance, and DOT/MC status before engaging.
- Compliance with all federal, state, and local regulations governing the contractor relationship in their jurisdiction.
- The terms of any independent contractor agreement signed with the contractor.
4. Contractor Responsibilities
Contractors are responsible for:
- Maintaining valid driver's license, commercial registrations, operating authority, and any required permits.
- Carrying appropriate commercial auto, cargo, and general liability insurance.
- Paying all applicable federal, state, and local taxes. OwnWorks does not withhold taxes.
- Vehicle maintenance, fuel, tolls, and all operating expenses.
- Compliance with FMCSA, DOT, and any other regulatory authorities applicable to their operations.
- Accuracy of profile information, including services offered and equipment listed.
5. No Guarantee of Work
OwnWorks does not guarantee any contractor will be selected, onboarded, or paid by any company. Posting a profile or expressing interest creates no entitlement to work.
6. Disputes Between Users
Disputes between contractors and companies, including payment, performance, scope, or termination, must be resolved directly between the parties. OwnWorks is not a party to and will not mediate these disputes.
